The Division of Labor determined that the Regulation of Trade – Weights and Measures rule is equal to its Federal counterparts because it adopts by reference the National Institute of Standards and Technology Handbook 130, Uniform Laws and Regulations in the Areas of Legal Metrology and Engine Fuel Quality and requires that all weighing and measuring devices meet or exceed the applicable requirements of the National Institute of Standards and Technology Handbook 44, Specifications, Tolerances, and Other Technical Requirements for Weighing and Measuring Devices. The National Institute of Standards and Technology (“NIST”) is an agency of the United States Department of Commerce.
