This rule is similar to Mine Safety and Health Administration’s (MSHA) rule setting forth the procedures a coal operator (or miner) uses to contest a violation. However, the monetary amounts MSHA assesses to its violations are significantly greater than the monetary amounts the West Virginia Office of Miners’ Health, Safety and Training assesses to its violations.
