This rule establishes a procedure for the resolution of enforcement actions and the assessment of civil penalties in lieu of the institution of a civil action as provided in W. Va. Code § 22-11-22.
This rule follows the parameters established in its federal counterpart regulation and is, thus, consistent with the federal program.
